Bisht, the learned Standing<br>Counsel for the State.<br>Heard.<br>Petitioner is serving as Head Constable,<br>Department of Excise Circle-4, Yamkeshwar,<br>District Pauri Garhwal. He was transferred from<br>District Pauri Garhwal to District Haridwar vide<br>order dated 08.08.2022. He has been placed<br>under<br>suspension<br>by<br>an<br>order<br>dated<br>10.09.2022<br>passed<br>by<br>the<br>Excise<br>Commissioner-respondent. The reason of his<br>suspension is death of certain persons, due to<br>consumption of spurious liquor.<br>Learned counsel for the petitioner would<br>submit that the petitioner joined at Haridwar<br>only on 16.08.2022, therefore, he cannot be<br>held responsible for the mishap, which took<br>place in District Haridwar.<br>Be that as it may, since suspension is not<br>punishment in the eyes of the law and all the<br>officers/ employees of concerned sector have<br>been put under suspension, therefore, this<br>Court does not find any reason to interfere in<br>the matter.<br>Having regard to the facts of the case, the<br>writ petition is disposed of by directing the<br>Competent Authority to conclude the enquiry as<br>early<br>as<br>possible,<br>preferably<br>within<br>four<br>months.<br>**( S.K.
