JUDGMENT
Petitioner has filed declaratory suit under Section 229-B of U.P.Z.A. & L.R. Act, in the year 2012, which is pending before Assistant Collector-I[st] Class, Kaladhungi, District Nainital and is registered as Revenue Suit No. 22/1392 of 2011-12.
2. Learned counsel for the petitioner submits that the said case was fixed for final hearing on 16.09.2021, however, the case could not be heard on the said date and thereafter no hearing could take place and the said suit is still pending.
3. By means of this writ petition, petitioner has sought direction to the Court concerned for expeditious hearing of the said suit.
4. Since the aforesaid suit was filed 10 years ago, therefore, the writ petition is disposed of with request to Assistant Collector-I[st] Class, Kaladhungi, District Nainital to hear and decide the same, as early as possible, preferably within nine months from the date of production of certified copy of this order. Unnecessary adjournments to the parties should be avoided.
