4669 of 2021. While giving challenge to the aforesaid proceedings, the 482 application is being supported with compounding application and the grounds taken therein jointly by the applicant, as well as, by the respondent no. 2 is that they had instituted proceedings under section 13(B) of the Hindu Marriage Act, which was registered as Hindu Marriage Case No. 363 of 2022, before the court of Principal Judge, Family Court, Haldwani, District Nainital, seeking dissolution of their marriage dated 20.04.2018. On the said proceedings, which have been jointly drawn by the applicant as well as respondent no. 2, decree of divorce has already been granted by the Family Judge, Haldwani by the judgment of 20.11.2022. Since, there is complete severement of matrimonial relationship, the respondent no. 2 has consented upon that in case if the present criminal proceedings are dropped in the light of the decree rendered under Section 13(B) of Hindu Marriage Act, she will have no grudges as against the present applicant. Since, now the matrimony between the applicant and respondent no. 2 has been dissolved, coupled with the fact that respondent no. 2, who is present in person duly identified by her counsel has made statement, that it is not possible for them to patch up their differences, coupled with fact, that she has also made statement that she does not
want to prosecute the present applicant any further, the proceedings of Criminal Case No. 4669 of 2021, State Vs. Suraj Bhatt pending consideration before the court of Additional Chief Judicial Magistrate, Haldwani, District Nainital would hereby stand quashed.
