|||||WPSS No. 861 of 2022 **Hon’ble Man oj Ku m ar Tiw ar i, J.** Mr. Amish Tewari, learned counsel for the petitioner. Mr. P.C. Bisht, learned Additional C.S.C. for the State of Uttarakhand. Mr. Lalit Samant, learned counsel for respondent nos. 2 & 3. According to petitioner, he is entitled to 5% horizontal reservation in public services, which is available to Orphans, as per Government Policy. Petitioner had applied pursuant to an advertisement dated 06.11.2020 issued by Uttarakhand Subordinate Service Selection Commission, whereby different Group ‘C’ posts were notified. Grievance of the petitioner is that result for Orphan category has not been declared by the Selecting Body. The prayer, sought in the writ petition, is as follows: - (i) writ, order or direction in the nature of mandamus directing the respondent no. 2 and 3 to declare the result of the eligible candidates including petitioner under the category of orphan in pursuance of the advertisement no. 29/m0v0ls0p0vk0/ 2020 dated 06.11.2020 (i.e. AnnexureNo. 1)for|

||||selection under Group ‘C’ giving benefit as per the Govt. Rule dated 31.08.2021 (i.e. Annexure no. 5) issued by Govt. of Uttarakhand. Mr. Lalit Samant, learned counsel appearing for the Selecting Body submits that since petitioner has approached the Competent Authority in the Selecting Body by making representation, therefore, decision on petitioner’s representation would be taken as early as possible. Accordingly, writ petition is disposed of with direction to Secretary, Uttarakhand Subordinate Service Selection Commission to take decision on petitioner’s representation dated 11.04.2022 (Annexure 8 to the writ petition), as early as possible, but not later than three weeks’ from the date of production of certified copy of this order.
