Bisht, learned Additional<br>C.S.C. for the State of Uttarakhand.<br>Mr. Lalit Samant, learned counsel<br>for respondent nos. 2 & 3.<br>According<br>to<br>petitioner,<br>he<br>is<br>entitled to 5% horizontal reservation in<br>public services, which is available to<br>Orphans, as per Government Policy.<br>Petitioner had applied pursuant to an<br>advertisement dated 06.11.2020 issued<br>by<br>Uttarakhand<br>Subordinate<br>Service<br>Selection Commission, whereby different<br>Group ‘C’ posts were notified.<br>Grievance of the petitioner is that<br>result for Orphan category has not been<br>declared by the Selecting Body.<br>The prayer, sought in the writ<br>petition, is as follows: -<br>(i) writ, order or direction in the nature of<br>mandamus directing the respondent no. 2<br>and 3 to declare the result of the eligible<br>candidates including petitioner under the<br>category of orphan in pursuance of the<br>advertisement<br>no.<br>29/m0v0ls0p0vk0/ 2020<br>dated 06.11.2020 (i.e. AnnexureNo. 1)for|
||||selection under Group ‘C’ giving benefit as<br>per the Govt. Rule dated 31.08.2021 (i.e.<br>Annexure<br>no.<br>5)<br>issued<br>by<br>Govt.<br>of<br>Uttarakhand.<br>Mr. Lalit Samant, learned counsel<br>appearing for the Selecting Body submits<br>that since petitioner has approached the<br>Competent Authority in the Selecting<br>Body<br>by<br>making<br>representation,<br>therefore,<br>decision<br>on<br>petitioner’s<br>representation would be taken as early<br>as possible.<br>Accordingly,<br>writ<br>petition<br>is<br>disposed of with direction to Secretary,<br>Uttarakhand<br>Subordinate<br>Service<br>Selection Commission to take decision on<br>petitioner’s<br>representation<br>dated<br>11.04.2022 (Annexure 8 to the writ<br>petition), as early as possible, but not<br>later than three weeks’ from the date of<br>production of certified copy of this order.<br>Till<br>decision<br>on<br>petitioner’s<br>representation, one post, in Orphan<br>category, shall be kept vacant.<br> <br> **( Man oj Ku m ar Tiw ar i, J.)**<br>13.05.2022<br>_Aswal_|
