Applicant Suraj Malik is in judicial custody in FIR No.411 of 2022, under Sections 392, 411, 34 IPC, Police Station Bahadrabad, District Haridwar. He has sought his release on bail.
2. Heard learned counsel for the parties and perused the record.
3. Learned counsel for the applicant would
submit that the co-accused has already been enlarged on bail; the role of the applicant is less serious than the co-accused already granted bail. Bail order dated 20.12.2022, passed in BA1 No.2772 of 2022, referred to, which is Annexure No.3 to the bail application.
4. Learned State counsel would submit that the co-accused has already been granted bail. It was an FIR, which is unnamed.
5. Having considered, this Court is of the view that it is case fit for bail and the applicant deserves to be enlarged on bail.
6. The bail application is allowed.
7. Let the applicant be released on bail, on his executing personal bond and furnishing two reliable sureties, each of the like amounts, to the satisfaction of the court concerned.
