have placed before this Court certified copy of the plaint of (Case No. 346 of 2022), Priya Chauhan Vs. Akshay Kumar and Others, which has been jointly preferred by the parties, to the proceedings before the court of Family Court, Haridwar seeking dissolution of their marriage dated 17.02.2020 by invoking the provisions contained under section 13(B) of the Hindu Marriage Act. The aforesaid proceedings, which was instituted on 02.07.2022 is still pending consideration, but, since the proceedings itself has been instituted by respondent no. 2, the complainant herein and as she has made statement before this Court, that it is not possible for her to continue the relationship any further coupled with the fact that the offences for which the summons have been issued, they all are personal offences arising out of matrimonial misunderstanding. The proceedings of Criminal Case No. 5297 of 2022, State Vs. Akshay and Others pending consideration before the court of Chief Judicial Magistrate, Haridwar would stand dropped in the light of the averments made in the compounding application, which has been duly signed by all the parties to the 482-application, including their respective counsels, who have verified its contents. Owing to the aforesaid, as consequence of the dropping of the criminal proceedings referred to hereinabove, the present 482 application would stand allowed. (Sharad Kumar Sharma, J.) 05.01.2023 Ujjwal
