Applicant Ashok Rohilla alias Kapil seeks bail in Sessions Trial No. 26 of 2020, State v. Deepak Sharma and others, which is based on the FIR No. 271 of 2019, under Sections 302, 120-B, 201 & 34 IPC, Police Station Nehru Colony, District Dehradun. This is second bail application of the applicant. His first bail application has been dismissed as withdrawn on 22.07.2021.

2. Heard learned counsel for the parties and perused the record.

3. It is argued that the co-accused having similar role have already been granted bail.

4. This fact is not disputed by the learned State Counsel.

5. Having considered, this Court is of the view that it is case fit for bail and the applicant deserves to be enlarged on bail.

6. The bail application is allowed.

7. Let the applicant be released on bail, on his executing personal bond and furnishing two reliable sureties, each of the like amount, to the satisfaction of the court concerned.
