Applicant is in judicial custody in FIR No.235 of 2020, under Sections 302 and 120-B IPC, Police Station Kelakhera, District Udham Singh Nagar. She has sought her release on bail.
2. Heard learned counsel for the parties and perused.
3. This is the second bail application. The first bail application, being BA1 No.694 of 2023, was rejected on 06.10.2023.
It is argued by learned counsel for the applicant
that it is case based on circumstantial evidence; the applicant was arrested on 16.11.2020; since then, he is in custody; out of 28 witnesses, till date, only 14 witnesses
have been examined; there are less chances of trial being concluded in near future.
5. Learned State Counsel admits these facts.
6. Having considered, this Court is of the view that it is case fit for bail and the applicant deserves to be enlarged on bail.
7. The bail application is allowed.
Let the applicant be released on bail, on her
executing personal bond and furnishing two reliable sureties, each in the like amount, to the satisfaction of the court concerned.
