Dateor directions COURT’S OR JUDGE’S ORDERSNo.and Registrar’s order with SignaturesWPSS No. 289 of 2025Hon’ble Rakesh Thapliyal, J.1.Mr. Tribhuwan Chandra Pandey, learned counsel for the petitioner. 2.Mr. Narayan Dutt, learned Standing Counsel for the State/respondents. 3.The petitioner by the instant petition is praying for the following reliefs: “(i) Issue writ order or direction in the nature of mandamus commanding and directing the respondent’s authorities to decide the representation of the petitioner dated 02.09.2024 forthwith and grant the Promotional Pay Scale to the petitioner from the date of his entitlement when he was completed twelve years of service in Selection Grade including the service rendered in the Government Primary School and Junior Basic School. ” 4.Learned counsel for the petitioner submits that identical issue came up before this court in the bunch of petitioner, the leading one is WPSS No. 602 of 2014 decided on 11.04.2017. He further submits that the aforesaid judgment was further followed in the subsequent writ petitions and the Coordinate Bench also decided on 23.08.2023 the similar issue in WPSS No. 1508 of 2023. 5.Since, for redressal of the grievance of the petitioner the petitioner already submitted representation, which is annexed as Annexure 5 to this petition dated 02.09.2024 to the Additional Director, Secondary Education, Kumaon Mandal, Nainital, therefore, the Additional Director, Secondary Education, Kumaon Mandal, Nainital, is directed to decide the said representation by reasoned and speaking order strictly in the light of the judgment passed by the Coordinate Bench dated 11.04.2017 passed in bunch of writ petitions as well as the another judgment passed by the Coordinate Bench dated 23.08.2023 passed in WPSS No. 1508 of 2023 within period of one month from the date of production of certified co of this order. py
