The petitioner is workman in whose favour Labour Court, Haridwar has passed an award on 28.03.2022. Total Rs.8,32, 576/- were to be recovered from the respondent no.2 for which Assistant Labour Commissioner, Haridwar issued the recovery citation to the Collector on 24.06.2024. Since recovery has not been made, therefore, the petitioner seeks direction that the respondent no.1 may be directed to the process of recovery.
2. Heard learned counsel for the parties and perused the record.
After dispute having been decided, the recovery
citation has been sent to the respondent no.1, Collector, Haridwar. It is an amount that has to be paid to the workman, who really needs it on time. What is stated is that the respondent no.1 is not taking any note of the recovery
citation. For the last more than eight months, no action has been taken on it.
4. This Court may not direct the respondent no.1, Collector, Haridwar giving any specific timeline to execute recovery citation sent by the Assistant Labour Commissioner, Haridwar. But, the Court expects from the respondent No.1 Collector Haridwar to take immediate steps so as to execute recovery citation, so that workman may get his dues at the earliest.
5. With these observations, the writ petition stands disposed of.
