HIGH COURT OF UTTARAKHAND AT NAINITAL

Writ Metition (M/S) No. 571 of 2025

Pawan Kumar and Another ...Petitioners

Versus

Co-operative Election Authority and Others ….Respondents

Present:-

Mr. A.K. Sharma, Advocate for the petitioners.

Mr. Ganesh Kandpal, D.A.G. with Mr. M.S. Bisht, Brief Holder for the State/respondent nos. 2 and 3.

Mr. Sandeep Kothari, Advocate for the respondent nos. 1 and 4.

Hon’ble Ravindra Maithani, J. (Oral)

By the instant writ petition, the petitioners challenge the order dated 17.02.2025, passed by the Returning Officer, by which the nomination papers of the petitioners have been rejected in the Cooperative Societies Election.

2. Heard learned counsel for the parties and perused the record.

Learned counsel for the petitioners would

submit that the nomination papers of the petitioners have wrongly been rejected; the petitioners are entitled to contest the election.

4. Learned State Counsel would submit that Rule 457 of the Uttaranchal Cooperative Societies Rules, 2004,

authorises such person to challenge the election by raising the dispute within 45 days of the result of the election. 5. The election process is already on. It is the case of the petitioners that their nomination papers have wrongly been rejected. They could challenge the election once it is over.

6. With these observations, the writ petition stands disposed of.
