|||||**WPSS No. 75 of 2024**<br>**Hon’ble Manoj Kumar Tiwari, J.**<br>There<br>is<br>no<br>representation<br>for<br>the<br>petitioners.<br>2.<br>Mr. Narain Dutt, Standing Counsel for the<br>State of Uttarakhand/respondent nos. 1 to 3.<br>3.<br>Mr. Rajendra Arya, Advocate, holding<br>brief<br>of<br>Mr.<br>Neeraj<br>Garg,<br>Advocate<br>for<br>respondent no. 4.<br>4.<br>Mr. Ashish Joshi, Advocate for respondent<br>no. 5.<br>5.<br>Petitioners are serving on contract as<br>Junior Assistant / Data Entry Operator in<br>Department<br>of<br>Food<br>and<br>Civil<br>Supplies,<br>Uttarakhand. They were engaged through an<br>outsourcing agency, namely UPNL.<br>6.<br>By means of this writ petition, petitioners<br>have<br>sought<br>a<br>mandamus<br>to<br>the<br>State<br>Government<br>to<br>make<br>policy<br>for<br>giving<br>weightage/bonus marks for their experience in<br>the selection held by Uttarakhand Public Service<br>Commission. Grant of relaxation / bonus marks<br>in selection is in the realm of policy decision,<br>therefore, such direction cannot be issued to<br>the State Government or the selecting body.<br>7.<br>However, the writ petition is disposed of<br>by<br>permitting<br>petitioners<br>to<br>make<br>representation to the State Government. If they<br>make representation to the Secretary, Food and<br>Civil Supplies, Uttarakhand within three weeks<br>from today, decision thereupon shall be taken<br>within four months thereafter.<br>**(Manoj Kumar Tiwari, J.)**<br> 12.09.2025<br>Navin|
