This is petition under Section 482 Cr.P.C. for quashing of FIRNo.206/2009, under Sections 279/337/338 IPC, registered at Police Station-R.K.Puram, Delhi and all the proceedings emanating therefrom.

Counsel for the petitioner has submitted that on 09.05.2009 at about09:40 a.m. in front of Police Chowki, Sector-4, R.K.Puram, main road, thepetitioner was driving vehicle bearing registration No. DL 2C Z 2143 verycautiously and in normal speed but due to error of judgment/human errorhit the vehicle bearing registration No. DL 1CJ 4805, resulting intoregistration of the present FIR. He has further submitted that medicalfacilities/expenses of the injured persons was taken care by the petitioner.He has further submitted that the injured Late Sh.Mahender Singh

(respondent No.4 herein represented through his wife Mrs.Chanchal) left forheavenly abode on 21.02.2014 due to old age and not because of theaccident. He has further submitted that after the registration of FIR thematter has been settled between the parties vide settlement deed dated03.05.2017 and nothing remains to be adjudicated upon further and submitsthat the FIR in question is coming as hurdle in the way of the presentpetitioner. He further submits that since all disputes have been settledbetween the parties, the FIR in question and all proceedings arisingtherefrom may be quashed.

The respondent No.2/injured, Mr.Kalyan Sahai and respondentNo.3/injured Mr.Surender Kumar are present in Court today and have beenidentified by the Investigating Officer, SI Kailash Chand, Police Station-R.K.Puram, Delhi. The respondent Nos.2 and 3 also admit that the matterhas been amicably settled with the petitioner. They further submit that thesettlement/compromise has taken place voluntarily, without any force,pressure or coercion. They further submit that they have no objection if theFIR in question is quashed.

Looking into the above facts and circumstances, since the matter hasbeen amicably settled between the parties and nothing remains to beadjudicated further, to meet the ends of justice, I deem it appropriate toquash the FIR No.206/2009, under Sections 279/337/338 IPC, registered atPolice Station-R.K.Puram, Delhi and all proceedings emanating therefrom.

The present petition is disposed of accordingly.

Copy of the order be given dasti as prayed.
