The present application on behalf of the petitioner has been preferredfor interim bail for period of two months in order to look after his ailingwife. Learned counsel for the petitioner submits that the petitioner’s wifehad fall from the staircase and she suffered fracture in her LumberVertebra for which she was advised operation.

The facts stated in the petition have been verified by the learned Statecounsel.

In the status report filed today which is taken on record, it issubmitted that the operation is scheduled to be performed on the wife of thepetitioner on 18.04.2017 in Eden Hospital.

This court is conscious of the fact that the petitioner is in custodysince 16.02.2014 in case instituted under Section 302 and other allied

sections of the IPC.

Considering the fact that the petitioner would be required at the timewhen the operation is performed upon his wife and there is only old motherat home, this court is inclined to grant the petitioner interim bail for 15 daysfrom the date of his release.

The petitioner in such circumstances is directed to be released on bailon his furnishing bond in the sum of Rs.25,000/- with two sureties of thelike amount to the satisfaction of the Trial Court.

The petitioner shall furnish his mobile telephone number and themobile telephone number of his sureties before the Trial Court which shallbe communicated to the Officer In-charge of the concerned Police Station.

The petitioner on his release on bail shall not indulge in any unlawfulactivity and shall surrender on the expiry of 15[th]day of his release. In casehe does not surrender on time, it would be open to the State to approach thetrial court for cancellation of his bail and taking of all coercive steps for himto be taken in custody. The petitioner, under any circumstances shall notleave the National Capital Region without intimating the Officer In-chargeof the concerned Police Station.

The bail application stands disposed of.
