The petitioner seeks parole for month to attend to his wifewho is stated to be suffering from psychiatric ailments in the nature ofdepression and suicidal tendencies.She is undergoing treatment atthe DDU hospital in its OPD. This aspect has been verified by thepolice as well as the residence of the petitioner. Ms. Richa Kapoor,the learned counsel for the State submits that the petitioner’s co-accused has jumped parole and NBWs have been issued against himfor 18.01.2018.
Be that as it may, the conduct of the co-accused cannot have abearing upon the present application, all the more so since the
petitioner was granted parole twice after the co-accused had misusedthe liberty granted to him.The petitioner’s conduct is otherwisesatisfactory.
In view of the verified medical exigency, the petitioner isgranted parole for period of four weeks from the date of his releaseon his furnishing personal bond in the sum of Rs.10,000/- with onesurety in the like amount to the satisfaction of the Jail Superintendentconcerned, subject to the following conditions:
(1)The petitioner shall report to the SHO, concerned Police Stationonce week on every Tuesday during the period of parole;once week on every Tuesday during the period of parole;
(2)the petitioner shall furnish his mobile telephone number, whichshall be kept operational at all times, to the SHO concerned;shall be kept operational at all times, to the SHO concerned;
(3)the petitioner shall not leave the territory of NCT of Delhi;
(4)the petitioner shall surrender before the jail authorities at theexpiry of the period of parole.expiry of the period of parole.
The petition stands disposed off in the above terms.
copy of this order be sent to the Jail superintendent
concerned and copy be also served through the police.
Copy of this order be given dasti to the learned counsel for theparties under the signatures of the Court Master.
