The petitioner has prayed for interim bail so as to enable the petitionerto attend to his wife who has to undergo operation in her lumber region. Theassertions of the petitioner have been verified and have been found to betrue.

Mr.Mukesh Gupta, learned advocate for the petitioner has informedthis Court that on earlier occasions, also the petitioner was released oninterim bail and on every occasion, he had surrendered before the jailauthorities on or before the end of such period of interim bail.

The wife of the petitioner has to be operated upon on 23.11.2017 inSakshi Hospital at Kanpur.

The petitioner has remained in jail since 07.11.2015. The trial in thiscase is in progress.

Taking into account the assertion of the petitioner that there is nobody

in his family to look after his wife during the period of operation, this Courtis inclined to release the petitioner on interim bail for period of 15 days.

The petitioner is directed to be released on interim bail for period of15 days, to be counted from the date of his release, on his furnishing bond inthe sum of Rs.10,000/- with one surety of like amount to the satisfaction ofthe Trial Court.

The petitioner shall, however, be subject to the condition that at thetime of furnishing his bond, she shall tender his and his surety’s mobiletelephone numbers which shall be kept in operative condition.

The petitioner shall be required to surrender before the jail authorities

on or before the end of the period of interim bail.

The application is disposed of accordingly.

The order be communicated to the Superintendent of the concernedjail for compliance and record.
