1.By the petition petition Dalip Kumar Ahuja sought grant of probate in respect of registered Will dated 24[th] June, 2003 of late Smt. Prem Das Gupta.
2.Notice in the petition was issued to respondents. Respondent No. 2 and 4 have filed their objections to the grant of probate.
3.After completion of the pleadings, matter was listed for recording of the petitioner’s evidence however, on 20[th] March, 2017 none was present on behalf of the petitioner. In the interest of justice the matter was adjourned to 3[rd] August, 2017 when again none was present for the petitioner nor petitioner’s witnesses were present. Subject to cost of ₹10,000/- one more opportunity was granted to the petitioner to lead evidence however, on the adjourned date, that is, 20[th] September, 2017 neither the costs was paid nor TEST.CAS. 62/2010 Page 1 of 2
anybody appeared for the petitioner nor were the petitioner’s witnesses present.
4.Considering that despite repeated adjournments none is appearing for the petitioner and the petitioner has led no evidence to prove his case, petition is dismissed.
