Bail Appln. 1302/2017
Learned senior counsel for the petitioner submits that petitioner hasnot been named in the FIR.It is further submitted that main accused-Bhupinder Singh, whose identity could be disclosed from the email portal, was declared P.O. on 16[th]March, 2017. FIR has been registered in the year2013; whereas petitioner has been summoned for the first time on 11[th]June,2017 on the pretext that he was also one of the directors of M/sclick2resume.com. Complainant has alleged that he had enrolled himself for
job with M/s click2resume.com. However, the company had fraudulentlywithdrawn `26,000/- from his account. Complainant has admitted that`17,746/- was returned by the company out of the Rs.26,000/- way back.Petitioner was merely an employee of M/s click2resume.com and later wasmade director with 0.10% shareholding.
Learned APP has opposed the bail application. He has contended thatduring the investigation, it has been revealed that petitioner was one of thedirectors and authorised signatory, therefore, his custodial interrogation isrequired.
Keeping in mind the totality of the facts and circumstances,it isordered that in the event of arrest, petitioner be released on bail subject tohis furnishing personal bond in the sum of `20,000/- with one surety in thelike amount to the satisfaction of the Investigating Officer/SHO/ArrestingOfficer of the concerned police station.
Bail application is disposed of in the above terms.
