CORAM:
HON'BLE MS. JUSTICE REKHA PALLI O R R
30.10.2018
1. Vide the present petition, the petitioners seek quashing of FIR No.158/2002 u/s 467/420/474/34 IPC registered at P.S Pahar Ganj.
2. At the outset, Ms.Arya, learned APP points out that by an order dated 07.03.2014 passed by this Court in an earlier quashing petition filed by the petitioners, the petitioners had been granted liberty to withdraw the said petition and subsequently file fresh petition explaining the incident leading to the filing of the captioned FIR. However, she submits that the aforesaid order of this Court has not been complied with as the petitioner has not at all explained the incident in the present petition also.
3. In view of the objection raised by the learned APP, learned counsel for the petitioners seeks leave to withdraw the present petition with liberty to file fresh petition incorporating the details of the incident leading to the filing of the FIR in question.
4. The petition and the pending application are dismissed as withdrawn with liberty as prayed for.
