For the reasons stated in the application, the application isallowed. The delay in re-filing the petition is condoned. Theapplication is disposed of.

CRL.M.C. 2815/2018

1.Learned counsel for the petitioner seeks impleadment of thedaughter of the complainant on the ground that she is an allegedvictim in the FIR. In view of the above, daughter of the complainantis impleaded as respondent no. 3. Amended memo of parties is takenon record.

2.The petitioner seeks quashing of FIR No. 1281/2015 underSections 354D/506/509 of the IPC, Police Station Hauz Khas, New

Delhi, based on settlement.

3.The subject FIR emanates out of dispute which aroseconsequent to advancing of loan. It is contended that compromisedeed dated 01.02.2018 has been executed.

4.Respondent no. 2 & 3 are present in person in Court today andis identified by the Investigating Officer. They submit that they havesettled the disputes with the intervention of locals and respectablepeople of the locality. Respondent No. 2 & 3 submit that they do notwish to press the criminal complaint against the petitioner any further.

5.In view of the fact that the disputes between the parties havebeen settled, continuation of criminal proceedings will be an exercisein futility and justice in the case demands that the dispute between theparties is put to an end and peace is restored; securing the ends ofjustice being the ultimate guiding factor. It would also be expedient toquash the subject FIR and the consequent proceedings emanatingtherefrom.

6.In view of the above, the petition is allowed.FIR No.1281/2015 under Sections 354D/506/509 of the IPC, Police StationHauz Khas, New Delhi and the consequent proceedings emanatingthere from are, accordingly quashed.

7. Order Dasti under signatures of the Court Master.
