It is however submitted at the outset on behalf of the petitioner by the learned counsel for the petitioner that CC No. 4997302/2016 filed by the respondent no. 2 against the petitioner has already been disposed of by the Court of MM (N.I. Act), South West on 20.12.2017 whereby the petitioner herein has already been acquitted qua the alleged commission of offence punishable u/s 138 of the N.I. Act and that the petitioner thus seeks to withdraw the present petition seeking liberty to seek redressal, if any, in accordance with law in relation to any action taken by the respondent no. 2.

The petition is dismissed as withdrawn with liberty granted as prayed.
