Crl. M.A. 4603/2018 (Directions)

During the pendency of this petition, compromise has been arrivedat between the petitioner (accused) and respondent no.2 (complainant).Accordingly, it is prayed that FIR No. 56/2013 under Section 354 IPCregistered at police station Kalkaji, on the complaint of respondent no.2-Geeta Giri may be quashed. Respondent no.2 is present in Court along withher counsel and has been identified by SI Satwinder of police stationKalkaji. She submits that she has settled the matter with the petitioner of herown free will and without any undue force, pressure or coercion vide

Compromise/Settlement Deed dated 8[th]February, 2018. Photocopy of thesettlement deed has been placed on record. Affidavit of respondent no.2 hasalso been annexed as Annexure ‘B’ to this petition. She has no objection incase FIR is quashed.

I am satisfied that compromise has been arrived at between thepetitioner and respondent no.2 voluntarily and without any undue force, pressure or coercion, therefore, in my view, no fruitful purpose would beserved in keeping the criminal proceedings pending.Accordingly, in theinterest of justice, aforesaid FIR and the consequent proceedings emanatingtherefrom are quashed.

Application as well as petition is disposed of in the above terms.Miscellaneous application is disposed of as infructuous. Date fixed in thematter, that is, 6[th]April, 2018 is cancelled.Dasti.
