1.The petitioner seeks quashing of FIR No. 792 of 2017 underSections 394/34 of the IPC Police Station Samaipur Badli, Delhi, onthe basis of settlement.

2.The allegations in the FIR are that the petitioners had stolenmoney from the pocket of Sh. Chunni Lal, uncle of respondent no. 2.Mr. Chunni Lal is also present in court and is identified by the IO. Hesubmits that he has also stated before the IO on 08.02.2018 that he hassettled with the petitioner.

3.A sum of Rs. 30,000/- was paid by the petitioners to respondentno. 2 in full and final settlement of all the claims and for settlement ofdisputes and no issue or dispute between the parties is stated to be

remaining.

4.Respondent no. 2 is present in court in person and is identifiedby the Investigating Officer. He submits that he has settled the disputewith the petitioners and is agreeable to the settlement and does notwish to press criminal charges against the petitioners any further.Settlement deed dated 01.12.2017 has been executed between theparties.

5.In view of the fact that the disputes between the petitioners andrespondent no. 2 have been settled, continuation of criminalproceedings will be an exercise in futility and justice in the casedemands that the dispute between the parties is put to an end andpeace is restored; securing the ends of justice being the ultimateguiding factor. It would be expedient to quash the subject FIR and theconsequent proceedings emanating there from.

6.In view of the above, the petition is allowed. FIR No. 792 of2017 under Sections 394/34 of the IPC Police Station Samaipur Badli,Delhi and the consequent proceedings there from are, accordinglyquashed.

7.Order Dasti under signatures of the Court Master.
