1.The petitioner seeks quashing of FIR No. 959/2016 underSections 379/356/411/34 of the IPC Police Station Vasant Vihar(Old), New Delhi.
2.The allegations in the FIR are that the complainant was goingon his motorcycle and the petitioners who were driving Santro Carcame in front of motorcycle on account of which minor altercationtook place between the petitioners and respondent no. 2. Whenrespondent no. 2 wanted to call police, petitioners snatched his mobilephone.
3.The petitioners and respondent no. 2 with the intervention ofelders have settled their disputes.
4.Respondent no. 2 is present in court in person, represented byhis counsel and is identified by the Investigating Officer. He submitsthat he has settled the dispute with the petitioners and is agreeable tothe settlement and does not wish to press the criminal charges againstthe petitioners any further.
5.In view of the fact that the dispute between the petitioners andrespondentno.2hasbeensettled,continuationofcriminalproceedings will be an exercise in futility and justice in the casedemands that the dispute between the parties is put to an end andpeace is restored; securing the ends of justice being the ultimateguiding factor. It would be expedient to quash the subject FIR and theconsequent proceedings emanating therefrom.
6.In view of the above, the petition is allowed. FIR No. 959/2016under Sections 379/356/411/34 of the IPC Police Station VasantVihar (Old), New Delhi and the consequent proceedings emanatingtherefrom are, accordingly quashed.
7.Order Dasti under signatures of the Court Master.
