Notice could not be issued to the respondent no. 2 as steps were nottaken by the petitioners.However, respondent no. 2 Ms. Chanchal hasappeared in Court along with her counsel.Respondent no. 2 has beenidentified by SI Samrat Khatiyan of police station Harsh Vihar. Respondentno. 2 submits that she has settled the matter with the petitioners of her ownfree will and without any undue force, pressure or coercion. She furthersubmits that her marriage with petitioner no. 1 has already been dissolved bya decree of divorce by mutual consent on 17[th]September, 2016 passed by
theFamilyCourts,ShahdaraDistrict,KarkardoomaCourts,Delhi.Petitioner no. 1 has handed over FDR of `50,000/- in the name of MasterBhavya. Respondent no. 2 submits that she has no objection in case FIR isquashed against the petitioner no. 1 and his relatives, that is, petitioner nos. 2to 6.
Keeping in mind the settlement arrived at between the parties and thatmarriage between the petitioner no. 1 and respondent no. 2 has already beendissolved, no fruitful purpose would be served to keep the criminalproceedings pending. Accordingly, FIR No. 99/2013 under Sections 498-A/406/34 IPC and Section 4 of the Dowry Prohibition Act, 1964 registeredat Police Station Harsh Vihar and the consequent proceedings emanatingtherefrom are quashed.
Petition is disposed of in the above terms. Dasti.
