Learned counsel for the petitioner submits that the petitioner has nocriminal record and has been falsely implicated. Nothing has been recoveredfrom the petitioner. Investigation is complete, in as much as, chargesheet hasalready been filed. Prosecution’s case is wholly based on circumstantialevidence and there is no independent evidence to connect the petitioner withthe alleged offence.

LearnedAPPsubmitsthatpetitioneralongwithco-accusedcommitted theft of 100 of spare parts of Bajaj three wheelers from shop.Certain other articles including TV and mobile phones were taken away bythe petitioner and the co-accused by hiring tempo.

Keeping in mind the totality of facts and circumstances, it is orderedthat petitioner be released on bail, subject to his furnishing personal bond

in the sum of `10,000/- with one surety in the like amount to the satisfactionof the trial court.

Bail Application is disposed of in the above terms. Dasti.
