Learned counsel for the petitioner submits that petitioner andprosecutrix were in relationship.After their relationship broke offprosecutrix filed the present FIR under Sections 323/376/377 IPC againstthe petitioner. Prosecutrix has falsely alleged that petitioner had developedphysical relations with her on the pretext of marrying her.It is furthersubmitted that petitioner has already handed over his mobile phone to theInvestigating Officer during the investigation.
Learned APP submits that petitioner has joined the investigation andhis mobile phone has been sent to FSL for retrieving the deleted data.
Keeping in mind totality of the facts and circumstances of this case, itis ordered that in case of arrest petitioner be released on bail, subject to his
furnishing personal bond in the sum of `25,000/- with one surety in the
likeamounttothesatisfactionofArrestingOfficer/InvestigatingOfficer/SHO of the concerned police station.
Bail application is disposed of in the above terms.
