1. This Public Interest Litigation has been preferred with the following

prayers:

“(i)Pass writ, order or direction in the nature of mandamus or any other writ, order, or direction of like nature quashing and setting aside the impugned Office Order dated 02.06.2020 of the Office of the General Director of Health Service, Government of NCT of Delhi; mandamus or any other writ, order, or direction of like nature quashing and setting aside the impugned Office Order dated 02.06.2020 of the Office of the General Director of Health Service, Government of NCT of Delhi; (ii) Pass writ, order or direction in the nature of mandamus or any other writ, order, or direction of like mandamus or any other writ, order, or direction of like

nature directing and commanding Respondent No.1 to comply with the Indian Council for Medical Research („ICMR‟) testing guidelines dated 18.05.2020 (Version 5) for COVID-19 testing in the State, and to Respondent No.2 to ensure compliance thereof by Respondent no.1; and

(iii) Pass such other order(s) as the Hon‟ble Court may deem fit and proper in facts and circumstances of the case.”

2.Having heard the counsel for both the sides and looking to the facts and circumstances of the case and also to the status report filed by the Government of NCT of Delhi, it appears that the Hon’ble Lieutenant Governor, being Chairperson of the Delhi Disaster Management Authority, vide order dated 8[th] June, 2020, has already set aside the impugned office order dated 2[nd] June, 2020 and restored the testing strategy recommended by ICMR in NCT of Delhi. In view of this status report filed by the Government of NCT of Delhi and looking to the latest order issued by the Hon’ble Lieutenant Governor dated 8[th] June, 2020, we see no reason to pass further orders in this Public Interest Litigation.

3.It is expected from the Government of NCT of Delhi that the directions issued by the Hon’ble Lieutenant Governor dated 8[th] June, 2020 shall be followed scrupulously.

4.With these observations, this writ petition is disposed of. Pending applications also stand disposed of.
