1. The present application under Section 439 Cr.P.C has been filed on behalf of the applicant seeking interim bail in FIR No. 79/2019 registered at P.S. Krishna Nagar for the offences punishable under Sections 302/120B/34 IPC and Sections 25/27 of the Arms act.

2. Learned counsel appearing on behalf of the applicant submits that the wife of the petitioner has been advised surgery for which he needs to get her admitted on 15.06.2024 at Jain Charitable Hospital, Raghuvar Pura, Gandhi Nagar, Delhi.

3. Status report dated 11.06.2024 authored by Insp. Mukesh Rana, SHO P.S Krishna Nagar has been handed over in Court and the same is taken on record. Perusal of records shows that the present applicant was admitted on interim bail which was granted by the learned Trial Court and was being

extended time and again. The order dated 27.05.2024 passed by the learned Trial Court records that despite several opportunities the advised surgery was not performed and , on account of the same he was asked to surrender. 4. Learned counsel for the applicant assures the Court that the applicant’s wife's surgery will be conducted and the latter shall not ask for interim bail on that account.

5. In view thereof, the applicant is directed to be released on interim bail for period of 10 days from the date of his release, on his furnishing personal bond of Rs.50,000/- with one surety of like amount, to the satisfaction of the learned Trial Court/Link Court, further subject to following conditions:

i.The applicant shall not leave India without prior permission of the learned Trial Court. learned Trial Court.

ii.The applicant shall intimate the learned Trial Court by way of an affidavit and to the Investigating Officer regarding any change in residential address. affidavit and to the Investigating Officer regarding any change in residential address.

iii.The applicant shall appear before the learned Trial Court as and when the matter is taken up for hearing. the matter is taken up for hearing.

6. The application is partly allowed and disposed of accordingly.

7. Pending applications, if any, also stand disposed of.

8. Copy of the order be sent to the concerned Jail Superintendent for

necessary information and compliance.

9. Order be uploaded on the website of this court forthwith.
