1.This is petition under Section 482 of CrPC seeking quashing of FIRNo. 0529/2022, under Sections 498A/406/34 of IPC, registered at PoliceStation North Rohini, and proceedings emanating therefrom.
2.It is stated that the parties have arrived at settlement dated17.05.2024 pursuant to which the petitioner no. 1 had to pay total sum ofRs. 2 lakhs to respondent no. 2, out of which Rs 1,00,000 has already beenpaid and the balance sum of Rs. 1,00,000/- has been paid today in Court byway of demand draft No. 288058 dated 11.12.2024 drawn on Union Bank,Sector 16, Rohini.
3.Petitioner is present in Court and has been identified by his counsel,Mr. Avinash Kumar.
4.Respondent no. 2 is also present in Court and has been identified byher counsel, Mr. Sunny and Investigating Officer, SI Sanju, Police Station
North Rohini.
5.Both parties state that they have entered into the aforesaid settlementout of their own free will, volition and without any threat, force, undueinfluence or coercion. It is stated by respondent No. 2 that she has noobjection if the FIR is quashed. There is no child born out of the wedlock.
6.Since the parties have arrived at settlement and no disputes arepending, I am convinced that quashing of such proceedings on account ofcompromise would bring about peace and would secure ends of justice. TheCourt does not see any fruitful purpose if criminal proceedings are permittedto be prosecuted any further. It is fit case for quashing.
7.In this view of the matter, FIR No. 0529/2022, under Sections498A/406/34 of IPC, registered at Police Station North Rohini andproceedings pursuant thereto are hereby quashed.
8.Accordingly, the petition is disposed of.
