1.This is writ petition under Article 226 of the Constitution of Indiaread with Section 528 of BNSS (erstwhile Section 482 of CrPC) seekingquashingofthemodificationrequestrejectionorderNo.F.10(3580864)/CJ/Legal/PHQ/2024/6761 dated 01.10.2024 and release of thepetitioner on furlough for two weeks on furnishing cash surety of Rs.10,000/-.

2.The petitioner was granted furlough on 31.07.2024 subject tofurnishing surety of Rs.10,000/- and personal bond. Since the petitionerwas unable to furnish surety to the tune of Rs.10,000/-, the petitioner movedan application seeking modification of that condition and undertaking to payRs. 10,000/- as cash security.

3.The same was rejected vide impugned order dated 01.10.2024.

4.For the said reasons, issue notice. Mr. Bhandari, learned ASC acceptsnotice and states that in case the petitioner deposits Rs.10,000/- with the Jail

Superintendent as condition for grant of furlough for period of 2 weeks,the same should be allowed.

5.Hence, the petition is allowed.

6.ThemodificationrequestrejectionorderNo.F.10(3580864)/CJ/Legal/PHQ/2024/6761 dated 01.10.2024 is set aside and thepetitioner is directed to be released on 2 weeks furlough on depositingRs.10,000/- and personal bond with the Jail Superintendent.

7.AllothertermsandconditionsoftheorderNo.F.10(3580864)/CJ/Legal/PHQ/2024/5851 dated 31.07.2024 shall remain un-altered.

8.The petition is disposed of accordingly.
