1. The present petition has been filed seeking the grant of interim bail

for six weeks on medical ground.

2. The medical report has been called from the Superintendent, Central Jail No. 1, and as submitted, the report dated 03.12.2024 reads as follows: -

3. Learned counsel the petitioner submits that the petitioner is not in good health and he requires urgent treatment.

4. Learned Additional P.P. has opposed the application on the ground that earlier application moved under same ground was dismissed as withdrawn. Learned Additional P.P. also submits that prosecutrix is yet to be examined and tomorrow is the date fixed before the learned Trial Court. Learned Additional P.P. also submits that the Regular Bail Application is also filed before the learned Trial Court and is now fixed for 13.12.2024. Learned Additional Public Prosecutor submits that the petitioner has prior criminal record and is involved in other cases as well.

5. This Court is of the firm view that prisoner has also the equivalent right to the adequate and effective medical treatment. The medical report indicates that the petitioner’s health is poor, and on 30.11.2024, the petitioner experienced fainting episode in the bathroom in the morning.

6. I consider that without going into the merits of the case and simply on the ground of medical condition of the applicant, the applicant be admitted on interim bail for period of 4 weeks from the date of his release, subject to furnishing personal bond of Rs. 20,000/- with one surety of the like amount to the satisfaction of the concerned learned Trial Court and subject to the verification of address and his mobile number(s), and subject to the following further conditions:

a)the petitioner shall not directly or indirectly make any inducement, threat, intimidate or tamper with any person acquainted with the facts of the case; inducement, threat, intimidate or tamper with any person acquainted with the facts of the case;

b)the petitioner shall remain available on the verified address except visiting to the hospital or doctor and shall not leave the GNCT of Delhi; except visiting to the hospital or doctor and shall not leave the GNCT of Delhi;

c)the petitioner shall further remain available on the mobile number provided and shall contact the investigation officer everyday at 5 P.M. number provided and shall contact the investigation officer everyday at 5 P.M.

7. Accordingly, the present petitionalong with pending application stands disposed of.
