1.Learned counsel for the Petitioner states that the Petitioner has instructions to withdraw the captioned Bail Application.

2.He however, prays that appropriate directions be issued to the trial

Court to proceed with hearing on ‘framing of charges’ since the main

charge-sheet was filed way back in July, 2022 and 2 ½ years have gone by.

3.He states that the hearing on ‘framing of charges’ has been deferred on last several hearings to await the Forensic Science Laboratory’s (FSL) report on the CCTV footage and Chance Print.

4.He has also drawn this Court’s attention to an earlier order dated 13.02.2024 passed by this Court in Bail Application No. 2270/2023, wherein observations for an expeditious trial were recorded.

5.Learned APP for State submits that CCTV footage was sent to FSL on

17.04.2023 and thereafter several reminder letters and priority letters have been issued to the FSL. He states however the report (after 19 months) is still awaited.

6.In the aforesaid facts, the Director, FSL is directed to prioritize and submit the FSL report in FIR No. 111/2022, P.S.: Defence Colony on CCTV footage as well as Chance Print to the (Investigating Officer) i.e., I.O. within four (4) weeks.

7.The Trial Court is requested to expedite the hearing on ‘framing of charge’ in this matter and preferably decide the same within four (4) months from 17.03.2025.

8.With the aforesaid directions, the petitioner is permitted to withdraw the present application seeking grant of the regular bail.

9.The petition along with pending applications stands disposed of.
