3.The present petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereafter ‘BNSS’) has been filed on behalf of the petitioner, seeking setting aside of the impugned order dated 04.10.2024 passed by the learned Additional Sessions Judge, South East District, Saket Courts, New Delhi in Session Case No.295/2024, vide which the charges have been framed against the petitioner under Sections 328/376/354(C)/506/376(2)(n) of the Indian Penal Code, 1860 (hereafter ‘IPC’) in FIR No.139/2024 registered at Police Station Okhla Industrial
Area, South East District, Delhi.
4.At the outset, the learned counsel appearing for the petitioner, seeks permission of this Court to withdraw the instant petition. He however prays that the learned Trial Court be directed to try this case expeditiously.
5.Accordingly, the petition is dismissed as withdrawn.
6.The learned Trial Court is also requested to ensure expeditious trial in this case. It is however clarified that the matter was not heard on merits, as it has been withdrawn with liberty to seek expeditious trial of the case.
7.The order be uploaded on the website forthwith.
