CRL.M.A. 30516/2025 (extention of parole for period of 4 weeks)

1.This is an application under Section 528 BNSS seeking extension of parole for further period of 4 weeks in case FIR no. 31/2010 under Section 302 IPC, PS Adarsh Nagar.

2.Vide order dated 03.09.2025, this Court in W.P. (CRL) 596/2025 granted parole of 04 weeks to the petitioner subject to various terms and conditions. The said parole period is to expire on 15.10.2025.

3.The Ld. Counsel who appears for the petitioner/applicant submits that condition of the applicant’s mother is serious. She has undergone multiple blood transfusions and life threatening surgeries but she is still not stable and may have to undergo emergency surgery at any point of time. It is stated that she is suffering from “Entrocutaneous Fistula” which is life threatening disease. According to her, the mother of applicant had undergone surgery on 06.08.2025 and has been discharged on 10.10.2025 but her condition remains serious. She has therefore, prayed for grant of 04 weeks extension of parole.

4.The Ld. Senior Standing Counsel who appears for the State does not dispute the medical condition of the mother but states that petitioner’s elder brother who is staying in Punjab can look after the mother. He further states that in case the parole is extended, the same may be considered as the second parole request for the current conviction year.

5.Considering the medical condition of the mother of the applicant which already stands duly verified by the State and on humanitarian consideration, the parole granted to the petitioner is extended for period of 04 weeks, subject to the previous terms and conditions and with direction that such extension shall be treated as the 2[nd] spell of parole granted in the current conviction year.
