1. This hearing has been done through hybrid mode.
2. The present petition under Section 482 of the CrPC read with Article
227 of the Constitution of India seeks the following prayers:-
“a) Quash the FIR No 110/2020 dated 07.08.2020, U/s 469, 500 IPC& 66-C I.T.Act registered at PS: Crime Branch, Central Delhi qua the Petitioner and all further proceedings arising out of the said FIR;
b) Issue ad-interim directions to the police officials to stay the investigation and/or not to take any coercive action against the Petitioner in relation to the FIR No 110/2020 dated 07.08.2020, U/s 469, 500 IPC& 66-C I.T.Act registered at PS: Crime Branch, Central Delhi during the pendency of this petition;
c) Pass such other and further orders which this Hon’ble Court may deem fit and proper in the facts and circumstances of the case
and in the interest of justice.”
3. During the course of hearing it has been pointed out that the charge-sheet in the present FIR has been filed before the Court of competent jurisdiction in March, 2023 and the matter is fixed for arguments on the point of charge. It is also submitted that the application seeking discharge of the present petitioner is pending before the learned Trial Court .
4. In view of the fact that the application seeking discharge is pending before the concerned Court. Learned Sr. Counsel seeks leave to withdraw the present petition with liberty to agitate the said application seeking discharge of the present petitioner which is pending before the learned Trial Court.
5. Leave and liberty granted.
6. The concerned learned Trial Court is directed to ensure that the arguments on the point of charge are heard and the issue is decided within 2 months from the passing of this order. It is made clear that no arguments have been addressed on the merits of the present case.
7. Order be communicated to the concerned learned Trial Court for the necessary information and compliance. for the necessary information and compliance.
8. Petition is disposed of in the above terms.
9. Pending applications(s), if any, are also disposed of.
10. Order be uploaded on the website of the Court forthwith.
